Terms of Service for Modern Word
Effective Date: July 12, 2026
Welcome to Modern Word, a mobile application (“App”) operated by Gee Bee Software LLC (“Gee Bee Software,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the App and its related features and services (collectively, the “Service”).
The App is made available on Apple’s App Store and Google Play. If you download or use the App on an Apple device, your license to use the App is also governed by the Apple Licensed Application End User License Agreement (the “Apple Standard EULA”), which is supplemented by these Terms with respect to App-specific features and services. Where these Terms and the Apple Standard EULA conflict as to the Apple-provided license, the Apple Standard EULA controls for that license; in all other respects these Terms govern your use of the Service.
This agreement is between you and Gee Bee Software LLC only, and not with Apple. Apple is not responsible for the App or its content and has no obligation to furnish any maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty, product-liability, legal-claim, or intellectual-property-infringement responsibility with respect to the App; those matters are addressed by these Terms and the Apple Standard EULA. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
The App relies on third-party services to operate, including but not limited to backend and analytics infrastructure, a subscription-management service, one or more third-party generative AI providers, and API.Bible for the delivery of certain Bible translations. These Terms describe your rights and responsibilities when you use the Service.
This document is a Terms of Service agreement only. It is not our Privacy Policy. Please review our Privacy Policy separately for details about how we collect, use, and handle information. Where these Terms mention data handling, they defer to our Privacy Policy for the details.
This document is provided for general informational purposes and is intended for review by legal counsel. It is not legal advice.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download, access, or use the App.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. These Terms form a legally binding agreement between you and Gee Bee Software LLC.
We may update or modify these Terms from time to time. When we make changes, we will update the “Effective Date” above. If we make material changes, we will make reasonable efforts to notify you, such as by email (if you have provided an email address) or through an in-app notice or prompt. Material changes may require you to re-accept the updated Terms before continuing to use certain features.
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
2. Description of Service
Modern Word is a Bible and spiritual-growth application that combines an in-app Bible reader with AI-assisted features, personal spiritual tools, progress tracking, and related functionality. The Service includes, without limitation, the following features. Some features are available to all users, while others require a paid subscription or are subject to usage limits that may vary by plan (see Section 5). Certain features may be enabled, disabled, or changed at our discretion.
AI-Assisted Features
- AI Chat and Scriptural Answers. You can send questions or messages and receive AI-generated, Bible-grounded responses in threaded conversations with history.
- AI Explain. AI-generated explanations and insights for a selected verse or passage, surfaced as multiple insight types (for example, lean-in, related verses, dig-deeper, and historical context), reachable from a selected verse in the reader, the Explain tab, or the Home screen.
- AI Study. AI-generated multi-chapter study content on a chosen topic, including a topic selector, a syllabus, and per-chapter generated content.
- AI-Generated Daily Verses. A personalized daily verse generated on a schedule and surfaced in the App (for example, as a Home hero, a Daily Verses pager and detail view, and a Meditate view), and optionally delivered via push notification.
- AI Weekly Suggestions. Scheduled AI generation of suggested questions, chat prompts, and study topics shown to eligible users.
- AI Personalization and “Memory.” The App may derive and store information from your activity to tailor AI output such as daily verses, suggestions, and, in some cases, answers. See Section 6 for more detail; data-handling detail is addressed in our Privacy Policy.
- AI Personality Selection. You may choose the tone or persona used by the AI from several available options.
- Response Ratings. You can rate AI responses — a one-to-five star rating (from “Not helpful” to “Extremely helpful”) on Explain results, and thumbs-up / thumbs-down feedback on chat, study, journal, daily-verse, and meditation surfaces.
Bible Reader and Progress
- Multi-Translation Bible Reader. An in-app, annotated Bible reader offering public-domain translations and, for subscribers, copyrighted translations delivered via API.Bible, with publisher-style formatting (such as section headings, red-letter words of Christ, and poetry and stanza layouts) and an in-reader translation switcher. See Section 7 for translation licensing.
- Bible Reading-Progress Tracking. Chapter read tracking, reading heatmaps and progress indicators, per-book progress, and a repeatable Cover-to-Cover whole-Bible reading goal with lap counting.
- Bible Activity View. A screen, reachable from a selected verse or passage in the reader, showing your annotations and activity tied to that selection.
Progress, Goals, and Gamification
- Achievements. Badges (or “stones”) organized into categories, streaks, and records, with a shared achievements screen and “NEW” indicators.
- Statistics. A dashboard showing time in the Word, streaks, counts, and rollups over daily, weekly, and monthly ranges.
- Daily Goals. Optional, opt-in daily goals with adjustable targets whose completion feeds streaks and records.
Personal Content Tools
- Journal. Journaling organized as threads and messages, with AI-assisted reflective responses and streak tracking.
- Notes. Personal notes with a composer, list, and detail views; the AI can help format note content and generate note summaries and topic tags.
- Prayer List. A user-managed list of prayer requests with statuses, including an unprayed-today count surfaced on Home, with AI assistance to parse and organize the prayer requests you enter.
- Prayer of Salvation / Dedication. A guided salvation or dedication prayer; recording it stores your salvation date.
Home, Navigation, and Personalization
- Home Dashboard. A Home screen with a paged feature grid, a daily-verse hero, and configurable statistic tiles.
- Customizable Tab Bar and Home Stat Tiles. You can choose and reorder the features shown in the bottom tab bar and select which statistic tiles appear on Home.
- Onboarding. A first-run flow covering welcome, a gospel or hope screen, AI personality selection, translation selection, notification opt-in, and setup.
Widgets
- Home-Screen and Lock-Screen Widgets. Optional iOS and Android home-screen widgets and iOS lock-screen accessory widgets that display a daily verse and app statistics, backed by an on-device cached snapshot with a local-midnight daily reset. See Section 10.
Account, Subscriptions, and Notifications
- Authentication and Account Management. Account creation and sign-in via email and password, Sign in with Apple, and Google sign-in; email verification; password changes; forgot-password; and self-service account deletion with a grace period and recovery before permanent deletion.
- Legal Agreements. An in-app flow to review and accept these Terms and our Privacy Policy, with the current documents viewable in the App.
- Subscriptions and Free Trials. Free and paid access with subscription gating and free trials, processed through the app stores and managed via a subscription-management service. See Section 5.
- Push Notifications. Optional, opt-in notifications for daily verses, streak reminders, study-continuation prompts, and inactivity nudges. See Section 8.
Growth, Feedback, and Other
- Spread the Word / Referral Program. A share and invite feature with a download link, QR code, and a per-user referral code, with referral crediting handled on our backend.
- In-App Review Prompts and App Update Prompts. The App may prompt you to rate the App or to update to the latest version.
- Analytics and Attribution. Install attribution and usage analytics, with an in-app option to turn off usage-data sharing. See Section 9.
- Experiments. The App may assign you to experiment variants that change what you see or how features behave.
The Service is provided on an “as is” and “as available” basis, as described in Section 15. We may add, change, suspend, or discontinue features at any time (see Section 20).
3. Eligibility
You must be at least 13 years old to use the Service. Users under 13 are not permitted to use the App, and we will terminate accounts that we determine belong to users under 13.
Users aged 13 to 17. If you are at least 13 but under the age of majority in your place of residence (generally 18), you may use the Service only with the involvement and consent of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf and who accepts responsibility for your use of the Service. By using the App, you represent and warrant that either (a) you are at least the age of majority in your place of residence, or (b) you are at least 13 years old and your parent or legal guardian has reviewed and agreed to these Terms and consents to your use of the Service. A parent or legal guardian who permits a minor to use the Service is responsible for the minor’s activity and agrees to these Terms on the minor’s behalf, including the dispute-resolution provisions in Section 18.
By using the App, you further represent and warrant that you have the legal capacity to enter into these Terms (or that your parent or legal guardian has done so on your behalf), and that you will comply with these Terms and all applicable laws and regulations. If you are using the Service on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.
4. Account Registration and Responsibilities
To use certain features, you must create an account. You may register using your name and email address or by signing in with Apple or Google. When you create an account, you agree to:
- Provide accurate, current, and complete information;
- Keep your login credentials secure and confidential;
- Notify us promptly of any unauthorized use of, or access to, your account; and
- Accept responsibility for all activity that occurs under your account.
You are responsible for maintaining the confidentiality of your account and credentials, and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to safeguard your account. You may manage or delete your account through the in-app account settings, including self-service account deletion, which is subject to a grace period and recovery window before permanent deletion.
5. Subscriptions and Payments
The App offers both free and paid access. Certain features, certain Bible translations, and higher usage limits require a paid subscription. Access to features may be gated by subscription level, and usage may be subject to usage or token limits that vary by plan. We may change which features are free or paid, and the applicable usage limits, at any time and without revising these Terms, and such changes generally take effect prospectively — for new purchases and upon renewal.
However, during a paid subscription term you have already purchased, we will not revoke your access to a core paid feature that was available to your tier when you purchased or most recently renewed that term, or move that feature behind a higher-priced tier, except where the change is required for legal, security, licensing, or technical reasons, or where a third-party provider (such as a Bible-content licensor or an app store) requires or causes the change. This does not limit our right to make such changes effective for future billing periods or new purchases. Changes to what is free or paid do not entitle you to a refund except as provided by the applicable app store’s policies.
Purchasing and billing. Paid subscriptions are purchased and billed through the Apple App Store or Google Play, and entitlements are managed through our third-party subscription-management service. All payments are processed by the applicable app store’s payment processor. We do not collect, process, or store your payment card details.
Auto-renewal. Paid subscriptions are auto-renewing. Unless you cancel, your subscription will automatically renew at the end of each billing period, and your payment method (through the app store) will be charged the then-current price for the applicable plan. Renewal, billing, and price changes are handled by the app store.
Free trials. We may offer free trials. Unless you cancel before the trial ends, the trial will automatically convert into a paid, auto-renewing subscription, and your payment method will be charged the applicable recurring price at the then-current billing frequency. The terms of any trial, including the recurring price, the billing frequency, and how to cancel, will be disclosed at the point of sign-up.
Cancellation. You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you will generally retain access to paid features until then.
Refunds. Refunds, where available, are handled by the applicable app store in accordance with its policies and, where relevant, the policies of our subscription-management service. We generally do not process refunds directly. Please review the app store’s terms for details on your refund rights.
You are responsible for reviewing the pricing, billing, renewal, and cancellation terms presented at the time of purchase and in your app store account.
6. AI Features and Content
Certain features of the Service use one or more third-party generative AI providers (each, an “AI provider”) to generate text, including AI chat and scriptural answers, verse explanations, study content, journal reflections, formatted notes, parsed prayer-list content, personalized daily verses, and weekly suggestions.
AI output may be imperfect. AI-generated content is produced by automated systems and may be inaccurate, incomplete, outdated, or otherwise unreliable, and it may not reflect any particular doctrinal, theological, or denominational position. AI output is provided for personal reflection and spiritual encouragement only. It is not a substitute for, and does not constitute, professional, pastoral, legal, medical, financial, or other professional advice. You should not rely on AI output as authoritative, and you should independently verify important information and consult a qualified professional or trusted spiritual leader where appropriate.
Personalization and “memory.” To make AI output more relevant and continuous across your spiritual-growth features, the App may derive and store information from your activity and messages and use it to tailor AI output such as daily verses, suggestions, and, in some cases, your answers. Where the App provides controls to reduce or clear this personalization, you may use them; the availability and behavior of such controls may change over time. Details about what is stored, how long it is retained, and how it is deleted are addressed in our Privacy Policy.
Processing of your inputs. When you use AI features, your inputs (such as your questions, messages, and related content) are processed by one or more AI providers in order to generate a response. That processing is subject to the applicable AI provider’s terms and to our Privacy Policy. For copyrighted Bible translations, verse text is not sent to the AI provider; only the verse reference is used to ground the response (see Section 7.4).
Your responsibility. You are solely responsible for the content of the inputs you submit to AI features and for how you use and act upon AI output. Do not submit content that is unlawful, that infringes the rights of others, or that you do not have the right to share.
7. Bible Content and Translation Licensing
The App provides Bible translations from two categories: public-domain translations and copyrighted translations licensed through API.Bible. Different rules apply to each. Your use of Bible content in the App is subject to this Section.
7.1 Public-Domain Translations
The App offers public-domain translations, including the King James Version (KJV) and the Douay-Rheims (DRA). These translations are in the public domain, and you may read, quote, copy, and share their verse text freely, subject to these Terms and applicable law.
7.2 Copyrighted Translations Licensed via API.Bible
The App also offers copyrighted translations that are provided under license and used by permission of their respective publishers, delivered through API.Bible (a service of American Bible Society). These currently include the New Living Translation (NLT), the New Living Translation Catholic Edition (NLTCE), and the New King James Version (NKJV). Access to copyrighted translations requires a paid subscription.
Copyrighted translations are provided “Powered by API.Bible.” The publisher copyright notices below are reproduced in the App with each copyrighted translation, and the App may also surface additional publisher- and API.Bible-mandated clauses (including the Creative Commons and no-translation restrictions described in Section 7.3 and publisher website links).

7.3 Restrictions on Copyrighted Verse Text
The copyrighted translations are protected by copyright and are made available to you solely for your personal, non-commercial use within the App. You may not copy, store, reproduce, redistribute, publish, sell, sublicense, or create derivative works from the copyrighted verse text, in whole or in part, except as expressly permitted by these Terms and by the applicable publisher’s terms.
In addition, and consistent with the requirements of API.Bible and the publishers:
- Copyrighted verse text may not be quoted in any publication made available to the public by a Creative Commons license; and
- The copyrighted translations may not be translated into any other language.
7.4 Reference-Only Export and AI Grounding
For copyrighted translations, the share and copy functions in the App’s Bible reader and verse cards are reference-only. When you share or copy a verse from a copyrighted translation there, the App provides only the verse reference and translation abbreviation (for example, “John 3:16 (NLT)”) and does not export the licensed verse text itself. Full-text share and copy are available only for public-domain translations. You agree not to circumvent this reference-only behavior or otherwise extract or redistribute copyrighted verse text from the App.
For the same reason, when AI features draw on a copyrighted translation, only the verse reference—never the licensed verse text—is used to ground the AI response. The copyrighted verse text is not transmitted to the AI provider (see Section 6).
Some AI-generated content in the App (such as AI-generated daily verses and AI responses) may include renderings of Scripture produced by the AI provider and attributed to a translation. Such text is generated content produced by the AI provider; it is not licensed verse text retrieved from API.Bible. You should treat any verse text attributed to a copyrighted translation as subject to the respective publisher’s copyright policies, and the restrictions in Section 7.3 apply to your use of it.
7.5 Usage Metrics (FUMS)
When copyrighted verses are displayed, the App sends fair-use usage-metric information to API.Bible’s Fair Use Management System (“FUMS”) as required by our license. This reporting uses a non-identifying, hashed user identifier and does not send your raw account identifier. FUMS reporting is a mandatory, non-optional condition of our API.Bible license; it is not analytics, and it is not affected by the analytics or usage-data-sharing opt-out described in Section 9. Additional detail about this data handling is addressed in our Privacy Policy.
7.6 Attribution and Publisher Resources
The App displays a full copyright citation with each copyrighted verse, a tappable “Powered by API.Bible” link, and links to the applicable publisher websites, as well as an in-app copyright page listing every available translation. The publisher website links are:

Your use of copyrighted verse content is additionally subject to the terms and copyright policies of the respective publishers and of API.Bible.
8. Push Notifications
The App may offer optional, permission-based push notifications, including daily verses, streak reminders, study-continuation prompts, and inactivity nudges. You choose whether to enable notifications, and you can manage your notification preferences — including which notification types you receive and, for daily verses, your preferred delivery time — within the App (for example, in Settings) and through your device’s operating-system settings.
To deliver and schedule notifications, the App may use information such as your device push token, a local device identifier, and your time zone. Notification delivery to a device stops when its push token becomes invalid (for example, after you uninstall the App); you can also turn off individual notification types in the App’s settings, or disable notifications entirely in your device’s operating-system settings, at any time. Data-handling detail relating to notifications is addressed in our Privacy Policy.
9. Install Attribution and App Tracking
The App uses a mobile attribution service (AppsFlyer) to measure how installs are acquired and to attribute marketing campaigns and referrals. Install-attribution information is captured around first launch. The App also sends a limited set of conversion events to the attribution service over time — such as registration, free-trial start, subscription purchase, premium-feature usage, and experiment-variant assignment — to measure marketing performance. These events are used for campaign measurement, not to build behavioral profiles or for personalized advertising.
On iOS, any use of the advertising identifier (IDFA) for cross-app tracking is subject to Apple’s App Tracking Transparency framework and requires your opt-in permission. Granting that permission is optional and does not affect your ability to use any App features, and you can change it at any time in your device’s Settings > Privacy & Security > Tracking.
The App also offers an in-app option to turn off usage-data sharing. This opt-out applies to in-app product-usage analytics only; it does not stop the conversion events described above, and it does not affect the mandatory FUMS usage-metric reporting required by our API.Bible license (see Section 7.5). Data-handling detail is addressed in our Privacy Policy.
10. Widgets
The App offers optional home-screen widgets (on iOS and Android) and lock-screen accessory widgets (on iOS) that can display a daily verse and selected app statistics. Widgets are powered by a cached, on-device snapshot of your data, which may include a local-midnight daily reset, and may display information that is not updated in real time.
Verse text shown in widgets comes from your AI-generated daily verse (see Section 6) and is not licensed verse text retrieved from API.Bible; Bible content shown in widgets remains subject to Section 7. Widget availability, layouts, and configuration options depend on your device and operating system and may change over time.
11. User Content
The Service allows you to create and store personal content, which may include your questions and chat messages, journal entries, notes, prayer-list entries, study interactions, response ratings, your recorded salvation or dedication date, and similar content (collectively, “User Content”).
License to us. You retain ownership of your User Content. By submitting or storing User Content in the Service, you grant Gee Bee Software LLC a non-exclusive, worldwide, royalty-free, transferable license to host, store, use, reproduce, process, adapt, and display your User Content solely as necessary to operate, provide, maintain, secure, and improve the Service, including transmitting relevant inputs to our AI and other service providers to deliver the features you request. This license ends when your User Content is deleted from our systems, except to the extent it has been shared with others, is retained in backups for a limited period, or must be retained to comply with law, in each case as described in our Privacy Policy.
Your representations. You represent and warrant that you own or have the necessary rights to your User Content and that your User Content, and our use of it as permitted here, does not violate any law or infringe or misappropriate the rights of any third party.
Moderation. We are not obligated to monitor User Content, but we may review, moderate, restrict, or remove User Content that we reasonably believe violates these Terms or applicable law, or that may harm the Service or others. We may do so without prior notice.
12. Intellectual Property
Except for User Content and for Bible content governed by Section 7, the Service and all of its contents—including the App’s software, source code, user interface, design, graphics, logos, text, and the framework used to generate and organize AI responses—are owned by Gee Bee Software LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws.
You may not copy, modify, adapt, translate, distribute, publicly display, sell, license, reverse-engineer, decompile, or disassemble any part of the Service, except as expressly permitted by these Terms, the Apple Standard EULA (where applicable), or applicable law. You may not use our names, logos, or trademarks without our prior written consent.
Bible content. Bible translations available in the App are subject to Section 7. Public-domain translations may be used freely; copyrighted translations remain the property of their respective publishers and are subject to the restrictions in Section 7.
AI output. As between you and us, and subject to the rights of the applicable AI providers and to Bible-content licensing, you may use the AI output generated for you within the App for your personal, non-commercial purposes. AI output may be non-unique, and similar or identical output may be generated for other users. You may not commercially reproduce, redistribute, or resell AI output or User Content except as expressly permitted.
13. Prohibited Conduct
You agree not to use the Service to, and not to permit or assist any third party to:
- Violate any applicable law or regulation, or engage in fraudulent, harmful, or deceptive activity;
- Submit or transmit content that is unlawful, defamatory, obscene, harassing, hateful, threatening, or that infringes or misappropriates the rights of others;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Attempt to gain unauthorized access to, disrupt, or compromise the security or integrity of the Service or its underlying systems, including our backend infrastructure, our subscription-management service, our third-party AI provider systems, or API.Bible;
- Use bots, scrapers, crawlers, or other automated means to access, extract, harvest, or collect Bible content, AI output, app data, or other content from the Service;
- Circumvent, disable, or interfere with the App’s reference-only export behavior, usage or token limits, subscription gating, or other access or security controls;
- Copy, store, reproduce, redistribute, publish, or create derivative works from copyrighted Bible verse text, or otherwise use Bible content in violation of Section 7;
- Interfere with or disrupt the Service or other users’ use of the Service, or introduce malware or other harmful code; or
- Use the Service in any manner that could damage, disable, overburden, or impair it, or that is otherwise inconsistent with these Terms.
14. Termination and Suspension
We may suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and without prior notice, if we reasonably believe that you have violated these Terms, engaged in prohibited conduct, failed to pay applicable fees, or created risk or possible legal exposure for us, or if we discontinue the Service.
Upon termination, your right to use the Service ceases. Your data may be deleted or retained in accordance with our Privacy Policy and applicable law. You may terminate your use of the Service at any time by deleting your account through the in-app settings or by contacting us at support@geebeesoftware.com. Sections of these Terms that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution—will survive.
15. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- AI-generated content will be accurate, complete, reliable, or suitable for any purpose. AI output is provided for spiritual encouragement and reflection only and is not professional, pastoral, legal, medical, financial, or other advice;
- The Service, including journaling, notes, statistics, widgets, and other features, will be available, uninterrupted, timely, secure, or error-free;
- Any data stored or transmitted through third-party services—including our backend and analytics infrastructure, our subscription-management service, our third-party AI providers, or API.Bible—will be secure or free from loss; or
- Any defects or errors will be corrected.
Your use of the Service and reliance on any content is at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GEE BEE SOFTWARE LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS (INCLUDING OUR BACKEND AND ANALYTICS PROVIDERS, OUR SUBSCRIPTION-MANAGEMENT PROVIDER, OUR THIRD-PARTY AI PROVIDERS, AND API.BIBLE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS (US $25.00).
Exceptions. Nothing in these Terms excludes or limits our liability where it would be unlawful to exclude or limit it. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, and for any other liability that cannot be excluded or limited under applicable law. The limitations and exclusions in this Section apply only to the maximum extent permitted by law and do not affect any non-waivable rights you may have as a consumer (see Section 18).
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless Gee Bee Software LLC and its officers, directors, employees, affiliates, licensors, and service providers from and against any and all third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach or alleged breach of these Terms; (b) your User Content; (c) your violation of any applicable law or the rights of any third party, including any infringement of Bible-content licensing under Section 7; or (d) your unlawful, infringing, fraudulent, or otherwise wrongful use of the Service, including any inputs you submit to AI features. This obligation does not apply to the extent a claim arises from our own breach of these Terms, our violation of applicable law, or our gross negligence or willful misconduct. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.
18. Governing Law and Dispute Resolution
Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles, and by applicable U.S. federal law, including the Federal Arbitration Act.
Your mandatory consumer rights. Nothing in these Terms — including the choice of governing law and venue, the disclaimers in Section 15, the limitations of liability in Section 16, and the dispute-resolution provisions in this Section 18 — excludes, restricts, or overrides any right or remedy you have under the mandatory consumer-protection laws of your country or state of residence that cannot be waived or limited by agreement. Where such mandatory laws apply, they prevail to the extent of any conflict with these Terms, and you may be entitled to bring proceedings in, and to the protection of the mandatory laws of, your place of residence.
Informal resolution. Before initiating any formal dispute, you agree to first contact us at support@geebeesoftware.com and to attempt in good faith to resolve the dispute informally. We will attempt to do the same. If the dispute is not resolved within a reasonable period (at least 30 days) after such notice, either party may proceed to arbitration as described below.
Binding arbitration. Except as otherwise provided herein, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules. The arbitration will take place in San Antonio, Texas, unless you and we agree otherwise or applicable law requires a different location. Judgment on the award may be entered in any court of competent jurisdiction.
Your right to opt out of arbitration. You may opt out of this agreement to arbitrate. To opt out, send us written notice within 30 days after you first accept these Terms (or first become subject to this arbitration provision) at support@geebeesoftware.com, with the subject line “Arbitration Opt-Out,” stating your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out applies only to this arbitration agreement; it does not affect any other provision of these Terms, and it will not affect your use of the Service or your subscription. If you validly opt out, neither you nor we will be required to arbitrate disputes, and either party may bring claims in a court of competent jurisdiction in accordance with the Governing Law provision above.
Class-action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
Coordinated or mass filings (batch arbitration). If 25 or more similar arbitration demands are asserted against us by or with the assistance of the same or coordinated counsel, or are otherwise coordinated, you and we agree that the demands will be administered in batches of up to 50 demands at a time. The AAA will (i) group the demands into batches, (ii) appoint a single arbitrator for each batch, and (iii) resolve each batch as a single consolidated arbitration. No demand in a later batch will proceed until the preceding batch has been resolved, and any applicable statute of limitations will be tolled for demands awaiting a batch. This provision does not create, and may not be construed to authorize, any class, collective, or representative proceeding. If a court or arbitrator finds this batch-arbitration provision unenforceable as to any set of demands, it will be severable as to those demands only.
Arbitration costs. Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s applicable rules, including its Consumer Arbitration Rules where those rules apply. Except where the arbitrator is authorized by applicable law to award fees and costs, each party is responsible for its own attorneys’ fees and costs.
Severability and exceptions. Nothing in this Section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual-property or proprietary rights, or from bringing an individual claim in small-claims court where eligible. Except for the class-action waiver, if any portion of this Section is found unenforceable, the remainder will continue in full force and effect. The class-action waiver is a material and non-severable part of this arbitration agreement: if the class-action waiver is found to be unenforceable, then the entire arbitration agreement in this Section will be null and void as to the claims subject to that finding, and those claims will instead proceed in a court of competent jurisdiction under the Governing Law provision above.
Apple App Store users. If you obtained the App through the Apple App Store, the dispute-resolution and other provisions of the Apple Standard EULA also apply to your license to use the App.
19. Third-Party Services
The Service relies on third-party services to function. Your use of the Service may be subject to these providers’ own terms and policies, and we are not responsible for their acts or omissions. These providers include:
- Firebase (Google LLC) — backend platform providing authentication, data storage, analytics, cloud messaging (push notifications), and backend functions.
- Subscription-management service (RevenueCat) — management of subscriptions and entitlements across iOS and Android.
- Apple App Store and Google Play — payment processing, billing, and auto-renewal for subscriptions.
- One or more third-party AI providers — generative AI that powers the App’s AI features (see Section 6). We may use more than one AI provider, and our providers may change over time.
- API.Bible (American Bible Society) — delivery of copyrighted Bible translations with publisher formatting, and receipt of required FUMS fair-use usage-metric reporting (see Section 7).
- AppsFlyer — mobile install attribution and marketing-campaign measurement (see Section 9).

20. Changes to the App and to These Terms
We may add, modify, suspend, or discontinue any feature or part of the Service at any time, with or without notice. We may also update these Terms from time to time as described in Section 1. When we make changes to these Terms, we will update the “Effective Date,” and, for material changes, make reasonable efforts to notify you. Material changes may require you to re-accept the updated Terms. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
21. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy and, where applicable, the Apple Standard EULA, constitute the entire agreement between you and Gee Bee Software LLC regarding the Service and supersede any prior or contemporaneous agreements or understandings, whether written or oral, on that subject.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. The severability rule specific to Section 18 governs that Section.
Assignment. We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any attempted assignment in violation of this provision is void.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. No waiver of any provision is deemed a further or continuing waiver of that provision or any other provision.
Force majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, or the failure or unavailability of third-party services or providers.
Notices. We may provide notices to you by email (if you have provided an email address), through in-app messages, or by posting within the App. You may send notices to us at support@geebeesoftware.com or at the mailing address in Section 22.
Headings. Section headings are provided for convenience only and do not affect the interpretation of these Terms.
